Seller and Worker Terms & Conditions

Sellers

Consignors who contact TTT to obtain a consignor slot on or after Sept 23, 2011 in return for working 8 hours or more, must complete their scheduled work hours in order to avoid the "NO SHOW" Volunteer penalty (listed below in the volunteer section of this waiver).  Consignors who were able to acquire a regular consignor slot or who were placed on the waiting list and acquired a regular consignor slot are not under any obligation to volunteer, but can choose to work if they would like to.

By consigning, the seller understands the risks involved in consigning. TTT  is not responsible for items lost, stolen, or misplaced during the event. TTT pays by the tags scanned at checkout, NOT by the seller's inventory report. TTT is not responsible for any discrepancies in inventory sheets versus items missing. Inventory sheets are strictly provided for consignor use.

Seller agrees that the distribution of proceeds from the sale of each item will be as follows:
All participants will have a consignor participation fee of $9.50 deducted after the appropriate percentage is calculated.
Consignor’s will receive 70% of their sales
4 Hour Workers will receive 70% of their sales
8 Hour Workers will receive 75% of their sales
12 Hour Workers will receive 80% of their sales
up to $2,000. Sales after the $2,000 limit will be paid at 70%.
16 Hour Workers (Managers) will receive 80% of their sales up to $2,000. Sales after the $2,000 limit will be paid at 70%.
20 Hour Workers (Specialty Workers) will receive 85% of their sales up to $2,000. Sales after the $2,000 limit will be paid at 70%.

All participants receive a guest

Seller understands it is against the law to sell recalled items. Seller agrees that All items being submitted by them into the TTT consignment sale have been accurately checked and verified by the seller, for recalls using the lists provided by the Consumer Product and Safety Commission (CPSC) or by contacting the item’s manufacturer directly. TTT may take action to prohibit any consignor who does not follow this Federal Law.

EVERY CONSIGNOR WILL BE IN CHARGE OF PLACING/SETTING UP THEIR ITEMS ON THE SALES FLOOR AFTER THEY HAVE GONE THROUGH INSPECTION. A worker will be stationed in each section of the building to clarify where you should place your items. Signage will also be provided to help you. Any abandoned items not placed on the sales floor by the consignor will be placed in the reject area. It is the consignor's responsibility to place an item in the correct area, or the item will not sell. 

Seller agrees to waive any and all claims for personal injury resulting from participation in TTT from whatever cause either foreseen or unforeseen against TTT, its owners, the lessors of the space where the sale is held, any volunteer or paid participants in TTT, or the insurer of TTT.

Seller agrees to hold harmless and make no claim against Tykes, Tots & Teens LLC (named TTT hereafter), its owners, the lessors of the space where the sale is held, any volunteer or paid participants in TTT, or the insurer of TTT for the damage, theft or loss of any items consigned to TTT.

If you were a registered consignor in the Spring of 2011 who did not participate and un-register as of 2/23/11, a double administration fee will be deducted from your current check in the Fall of 2011. This penalty DOES NOT apply to a consignor who un-registers during the registration period. The purpose of this penalty is to discourage individuals from filling up consignor slots, drop off slots, and worker slots, which does not allow these slots to be filled by participating consignors. The deadline if you need to un-register for this event, is October 12, 2011 before 2:00pm.

On a case by case basis, items that have been misrepresented by the consignor, or consigned with the intent to mislead a customer, TTT may offer a return. Once the event is closed, TTT cannot offer any refunds. This policy does not apply to apparel. TTT holds their consignors responsible for these situations as they arise.

TTT reserves the right to refuse any item during drop off. TTT also reserves the right to pull any item off the sales floor that does not meet their requirements.

Seller agrees to inform any alternate dropping off items for them with the following information: Seller number, consignor name, and, if applicable, how many hours the consignor is registered to work. This information is necessary for us to issue the correct pre-sale passes. Seller gives alternate permission to check in, fill out, and sign the necessary paperwork at drop off on their behalf.

Seller agrees that on the last two days of the sale, all unsold items with a STAR symbol that visibly appears above the price and that is embedded into the barcode of the tag, will be discounted by 50 percent. Each seller has the option to mark an item for discount while creating their tags.

Seller agrees that items marked with a "D" in the bottom left corner of the tag will be donated if unsold. Donate items will not be available for pick-up. Each seller has the option to mark an item for donate while creating their tags. All donate items will be eligible for "Dollar Dash".  Dollar Dash is held after our 50% Off Days have concluded. This season, Dollar Dash will be held on October 15, 2011 from 8pm-10pm. Any item marked for Donate, that has not sold prior to Oct 15, 2011 by 8pm, will be for sale for $1.00.  If the Donate item does not sell during Dollar Dash, it will be donated.

Seller understands that it is their responsibility to fill out each item's tag completely and properly. Seller agrees that any item found WITHOUT a tag, or with an illegible tag will be withheld in a lost and found area so that we may attempt to locate the tag or search for description information in our computer system. If the consignor's tag is reunited to the item we will put the item back on the floor for resale. If no information can be found for the item, or if descriptions found are too vague to guarantee it matches an item, it will be put in an unclaimed area for consignors to rightfully and honestly claim during pick up. A proof of claim is mandatory for tagless items claimed during pick up.

Consignors and alternates are required to show proof of identification at pick up.

Seller agrees that ITEMS NOT PICKED UP by the end of the designated pick-up period will become the property of TTT to be donated to charity or any other sources that could benefit from them. Pick up for the Fall 2011 event is on Wednesday, October 19, 2011, from 10:00am - 8:00 pm. No Reschedules, No Exceptions. 

Seller agrees to cash issued proceed checks within 45 days of the date of the check. Checks will be void after this time. In the circumstance that a check is lost or misplaced, TTT will re-issue the consignor’s check after the void date of the original check.

TTT is not responsible for seller email accounts that do not accept mail from the TTT e-mail address, Conyers@TTTsale.com

 

Workers

  • Workers can cancel or re-schedule their work shift(s) and avoid sales percentage penalties by canceling at least 2 days BEFORE their scheduled shift(s).
  • Consignors or alternates who do not attend their scheduled work shift(s), without properly canceling, will be penalized 50% of their sales.
  • Workers who cancel their shift or reduce their amount of hours to work, must return and exchange their worker pre-sale passes directly to Laura during the event to avoid penalty of using or keeping incorrect pre-sale passes. If you do not fulfill the required amount of work hours for the worker passes you received, and then you do not return the passes, you will be charged $10.00 per hour of work that was not completed in accordance with those passes.
  • Workers who do not complete their stated/scheduled hours will be penalized an incomplete fee of $10.00 per hour not completed.
  • Workers who let socializing, shopping or slacking get in the way of their job, won't be allowed to participate as a worker again.
  • Incentives are not offered for less than 4 hours of work.
  • 4 hour and 8 hour workers can choose any combination of shift(s) available online to equal exactly 4 or 8 hours.
  • 12 hour workers must sign up for at least 8 hours on either opening Saturday (October 8) or on any of the sort days. The 8 hours can also be split between these days. The remaining hours can be any shift(s) listed online.
  • 16 hour and 20 hour workers must submit the request form to TTT to be approved for a specific schedule and specific work duties. 
  • It is the worker's responsibility to sign IN and OUT when working, including on meal breaks. This is TTT's record to give workers appropriate credit.
  • Take your situation into consideration and understand TTT's policy BEFORE committing to work. Consignors are responsible for contacting TTT for cancellations or re-schedules in order to avoid penalties. We understand last minute emergencies arise, so all workers should have a "Back Up" worker just in case.
